Generally

These terms of sale apply to all sales of products from music-miljo.no to consumers (private individuals). For persons other than private persons, the same conditions apply, with the exception of the right of withdrawal. For dealers and other customers with organization numbers, their own terms apply.

The terms of sale together with your order, confirmed through an order confirmation, constitute the total contract basis for the purchase.

The terms of sale and other information on www.randefalkmusic.com are only available in Norwegian.

To be able to shop at www.randefalkmusic.com you must have turned 18 years old.

We mainly supply to Norway, Svalbard, the Norwegian continental shelf and other remote Norwegian areas, but also accept orders from other countries.

Consumer purchases are regulated in the Consumer Purchase Act, the Right of Withdrawal Act, the Marketing Act, the Personal Data Act, the e-commerce Act and the Credit Purchase Act. Follow the links to these laws for more information about your rights and obligations when buying.

Where these terms of sale require writing, this is fulfilled by using e-mail, text message to mobile phone (SMS), letter, fax or the like.

and hereinafter referred to as "we" or "us". The buyer is: the person who is stated as the buyer in the order, and hereinafter referred to as "you", "you", "your" or "yours".

 

  1. Implementation of purchases in the Web shop www.randefalkmusic.com

To make you feel confident about how to order / shop in our online store, we have described the buying process as a separate item:

  1. Order and contract process

Your order is binding when the order is registered on our server (computer). We are also bound by your order if this does not differ from what is offered by us in our online store, our marketing or otherwise. However, you have the right to withdraw from the purchase pursuant to the Right of Withdrawal Act, see more in point 11 of the agreement.

When we receive your order, we will confirm the order and automatically send you an order confirmation. Please read the order confirmation carefully when you receive it and check if the order confirmation is in accordance with the order. Exceptions may occur, see section 4.

 

  1. Information provided in the online store

We strive to provide our customers with accurate information about our products as possible. However, we make reservations that typing / printing errors may occur, which may mean that we cannot deliver according to information provided in our online store, our marketing or otherwise.

Furthermore, we reserve the right to cancel your order or part of it, if the product is sold out. In case of sold-out situations, you will receive notice of this, possibly together with information about what we can offer instead.

You will have the opportunity to accept our new offer with the changes we make regarding your order or cancel your order.

 

  1. Prices

All prices are inclusive of VAT. The total cost of the purchase will appear before the order and include all expenses associated with the purchase as expenses for postage, shipping, packaging etc.

 

  1. Payment

 

We send an invoice to all bands / cultural schools and other organizations that are registered in our customer register with organization number, or others where there is an existing agreement on this. All shipments are sent together with the invoice.

Invoice is issued by shipping and is due for payment within a reasonable time, and no later than 10 days if you are not registered with other payment terms with us from before.

Unclaimed and unpaid packages will be charged a fee of NOK 200 to cover our expenses.

In case of non-payment, the claim will, after prior notice, be sent for collection.

For partial deliveries, only the partial delivery is charged.

In case of late payment interest accrues in accordance with the law on default interest, currently 12% per year.

 

  1. Delivery and delay

The correct address

The customer is responsible for ensuring that the correct address and postal code are stated in the profile. Address change is done in My account. Registered address will be the delivery address, but it is possible to add alternative address for delivery if desired.

 

Delivery

If there are goods we cannot deliver from stock, you will be notified when you place the item in the shopping cart. You therefore get a good overview of whether the goods can be delivered quickly or have to be ordered. Stock items are usually shipped 1-5 working days after ordering. We take reservations for some longer delivery times in periods where randefalkmusic.com or the post office or shipment company has a lot of traffic. It is your local post office or shipment company that is responsible for sending out a receipt, which you will receive by SMS or email. Goods ordered online that are not picked up or refused received will be returned to us at the customer's expense.

Goods that we normally do not stock (special order) can normally be sent out about 3-5 weeks after ordering, but we must make reservations for longer delivery times from some manufacturers. We try as best we can to provide information on delays.

 

Shipment

We normally ship items as letters in the mail right home to your mailbox if the shipment is less than 1 kg.

For shipments over 1 kg, we normally use Post office Service Package which covers all of Norway and has a quality, speed and price that cover most shipping needs. The package is normally available two or three days after shipment. For larger packages, we now use Postnord or DHL.

If the delivery of the products is delayed, we will provide you with information as soon as we have knowledge of it, together with information about and possibly when delivery can take place, or if the product (s) are sold out. randefalkmusic.com reserves the right to cancel your order or parts of it, if the product is sold out.

In case of sold out situations, you will receive notice of this, possibly together with information about what we can possibly offer instead. You will have the opportunity to accept our new offer with the changes we specify in relation to your order.

 

  1. Examination of the products

After receiving the products, as soon as you have the opportunity, you should check whether the delivery is in accordance with the order confirmation, whether the products have been damaged during shipping, or whether the products are otherwise defective or missing.

 

  1. Your rights in case of errors and defects (Complaints)

If the products have faults or defects, you can, according to the circumstances, demand a correction of the defect, replacement, price reduction, compensation or that the purchase be lifted.

The error must exist when you get the products in your possession. However, faults you discover within six months of receiving the products should normally be considered as errors that occurred before you received the products. Notification of errors and defects in the products can be conveyed to us orally or in writing. This must happen within a reasonable time after you discovered the error or defect. However, you always have at least two months' notice period. We strongly recommend that the complaint be sent to us in writing.

We will confirm receipt of all complaints in writing. We will also confirm in writing the receipt of goods returned to us or our service workshop for inspection or error correction. The right to a complaint comes in addition to the right of withdrawal pursuant to section 11.

 

  1. Warranty

Our guarantees do not imply any limitations on the warranty period for goods under the Consumer Purchase Act. The complaint deadline is two years after you took over the goods, or five years if the item is intended to last substantially more than two years. See also point 9

 

  1. Right of withdrawal

The right of withdrawal gives you the right to undo your purchase. The right of cancellation applies to goods and to certain services (see exceptions further down).

The right of cancellation assumes that you notify us no later than 14 days after you receive the delivery (notice period).

If you have not received a right of withdrawal form either in the order confirmation or on delivery of the products, this deadline is extended to three months.

In order for the right of withdrawal to be enforceable, the product must be delivered to us in approximately the same amount and condition as you received it.

All products must be returned to us within a reasonable time. Any return shipment must be paid by you. We have the risk of transport back to us. We are obliged to repay to you what you have paid including shipping for the shipment to you. Refund must be made within fourteen days after we receive the product from you or the pickup note or the product is provided to us. The product is returned to us, if possible in original packaging, together with the right of return form. Further details on how to use the right of withdrawal can be found in the right of withdrawal form.

NB: right of withdrawal applies only to private purchases - not company purchases / organizations / cultural schools / corps / other institutions etc.

  1. Personal information

We basically treat only the personal information you provide to us and that are necessary for us to be able to fulfill our obligations to you. In cases where we also process personal information for other purposes, for example, to send you information about offers etc., this is done only when you have consented to it. Before you consent, you must be informed of what the information is to be used for and by whom.

We reserve the right to request a social security number to be able to check the creditworthiness of credit purchases or the date of birth to check whether our customers are under 18 years of age. Your personal information will only be disclosed to others when:

  • you have consented to the extradition, or
  • when it is necessary for us to have the agreement with you, or
  • in the statutory case.
